Locate the custody record before looking for a photograph

Virginia does not have one verified statewide public gallery covering every jail and prison photograph. Start with the agency holding the person or the image. VADOC’s Inmate and Supervisee Locator includes state institutions, probation and parole supervision, institutional hospitals, Community Corrections Alternative Program participants, and people in local or regional jails under VADOC authority. A recent local booking outside that authority needs the local jail or sheriff’s route.

Search with the seven-digit DOC ID, or at least the first three letters of the first name and the full surname. Optional location, age, race and gender filters can narrow candidates, but an apparent match still needs identifier checking. Save the DOC number and listed location. VADOC updates the locator daily and expressly warns that information can be inaccurate or outdated.

Separate the initial booking image from other inmate photographs

Virginia Code § 2.2-3706(A)(1) addresses adult arrestee photographs taken at initial intake as part of routine booking. Those photographs are subject to release under FOIA, except for a delay needed to avoid jeopardizing a felony investigation. That narrow rule does not mean every photograph taken during imprisonment must be published online.

The same statute separately treats imprisonment-related records as discretionary releases and prohibits disclosure of expunged or sealed records except where the law authorizes it. Identify whether you want the first booking image, a later correctional identification photo or another record. Do not apply the adult-booking rule to a juvenile’s record or assume a public name result removes confidentiality restrictions.

Send a focused request to the actual custodian

For an image held by VADOC, email [email protected]. Include your name and legal address, which the department requires, and describe the existing record specifically: subject’s name, DOC ID, approximate photograph date, facility and image type. Request an electronic copy if suitable and ask for a cost estimate before work begins. Virginia FOIA guarantees access for Commonwealth citizens; a requester outside Virginia should ask whether the agency will fulfill the request voluntarily.

For a local booking image, use the booking jail or arresting agency’s official records contact with the booking reference and date. A request to VADOC cannot compel it to supply a photograph held only by a different agency. If you do not know the custodian, ask the facility named on the booking paperwork which agency created and retains that image. Do not send sensitive identifiers to an unrelated mugshot-removal or search business.

Ask for an existing photograph rather than asking staff to create a new report about the person. VADOC accepts requests without a mandatory written form, but a written request preserves your wording, date and requested delivery method. The agency cannot require an explanation of why you want the records, although identity and address information may be requested.

Budget for actual work and read the response carefully

VADOC must respond within five working days after receipt, counting from the next workday and excluding weekends and holidays. A response can release records, explain a complete or partial withholding, say records were not found, or explain why an additional seven working days are needed. The five-day rule is not an unconditional promise that the image will be delivered within five days.

Charges can cover actual search, retrieval, copying, postage and other direct response costs. There is no verified flat statewide mugshot price. VADOC requires a deposit when its estimate exceeds $200, and the response clock excludes time awaiting that deposit. Request an estimate and narrow the date range or image type if it is too high. When material is withheld, look for the cited statutory basis rather than assuming silence means no record exists.

Keep the photograph’s date and legal meaning attached

Compare the returned image’s agency, DOC or booking identifier and date with the request. A face resemblance alone is insufficient attribution. If the wrong person or date is supplied, send the custodian the conflicting reference and ask it to check the record. An old photograph cannot establish current custody, and an arrest photograph cannot establish a conviction. For the outcome of a charge, obtain the relevant court disposition. Keep any release, dismissal or correction with the material you retain so that a historical booking is not presented as the person’s present legal status.
